Article 1 – Definitions
Within these Terms and Conditions, the following terms shall be interpreted as follows:
Right of withdrawal: The period during which the consumer may exercise their right to cancel the transaction.
Consumer: A private individual who is not acting in the course of a trade or profession, and who enters into a distance agreement with a business.
Day: A calendar day.
Continuous agreement: A distance agreement concerning a number of products and/or services provided during a certain period.
Durable storage medium: Any means that allows a consumer or business to store personal information in a way that it can be accessed and reproduced without alteration in the future.
Right of cancellation: The consumer’s ability to cancel the agreement within the cancellation period.
Business: Manawa Bay Boutique – the company that provides products and/or services to consumers remotely.
Remote agreement: An agreement concluded through remote means of communication between the consumer and the business.
Remote means of communication: Any method that allows a transaction to be concluded without the consumer and the business being physically present together.
General terms and conditions: These terms and conditions of Manawa Bay Boutique.

Article 3 – Applicability
These terms and conditions apply to every offer made by Manawa Bay Boutique and to any distance agreement concluded between Manawa Bay Boutique and the consumer, including any orders placed through the website.
Before concluding a distance agreement, these terms and conditions will be made available to the consumer. If this is not possible, consumers will be informed of where the conditions can be reviewed on the Manawa Bay Boutique website and that they can be provided upon request.
Article 4 – The Offer
If an offer has limited validity or is subject to specific conditions, this will be clearly stated.
All offers are subject to change; Manawa Bay Boutique reserves the right to update or modify offers at any time.
Product descriptions will be accurate and detailed enough to allow consumers to make an informed decision.

Article 5 – The Agreement
An agreement is established when the consumer accepts the offer and meets the stated conditions.

Article 6 – Right of Cancellation
When purchasing products, the consumer may cancel the agreement within 30 days from the date of receipt, without giving a reason.
The cancellation period starts on the day after the consumer or their representative receives the product.
Article 7 – Return and Refund Costs
If the consumer exercises their right of cancellation, the cost of returning the goods shall be borne by the consumer.
If the consumer has made any payments, Manawa Bay Boutique will refund the amount as soon as possible, but no later than 30 days from the date of the cancellation notice.
Article 8 – Exclusions from the Right of Cancellation
Manawa Bay Boutique may exclude the right of cancellation for certain products, such as customised items or products that cannot be returned for hygiene reasons, provided this is clearly stated in the product description or offer.
Article 9 – Prices
During the validity period of an offer, product prices will remain unchanged except for variations resulting from changes in tax rates or government regulations.
Price changes within three months of the agreement date are only permitted if they are the result of statutory provisions.
Article 10 – Product Compliance and Liability
Manawa Bay Boutique guarantees that its products correspond to their descriptions on the website, meet reasonable standards of quality, and are suitable for normal use.
Defects or incorrect deliveries must be reported by the consumer in writing within 30 days of receipt.
Article 11 – Delivery and Performance
Manawa Bay Boutique will process confirmed orders as soon as possible and no later than 30 days from the date of the order, unless the consumer has agreed to a different timeframe.
Article 12 – Ongoing Agreements: Duration, Termination and Renewal
A consumer may cancel an agreement of indefinite duration at any time, subject to the applicable cancellation rules, by giving no more than one month’s notice.
